1. General provisions

These terms of use govern the method of member registration, the rights and obligations of members, the method of conducting transactions, as well as the privacy policy, the protection of copyright and related rights, and other essential matters relevant to the functioning and use of the service. Online shops ( www.jspfashion.com), which operates within the corporate system of the company IDENTITY.PLUS PREDUZEĆE ZA PROIZVODNJU I TRGOVINU ODEVNIM PREDMETIMA DOO BEOGRAD (STARI GRAD) Skender Begova 3 A 11000 Belgrade (hereinafter: JSP FASHION).

Access to the products of the online shop will be available seven days a week, 24 hours a day. Exceptionally, the shop may be temporarily unavailable due to routine technical maintenance, as well as other circumstances for which JSP FASHION is not responsible, in accordance with clause 6 of these Terms of Use.

The online shop contains a product catalogue which includes a list of products, as well as: 

  • Product name and description;
  • the price including the applicable value added tax;
  • at least one photograph of the product; 
  • an indication of whether the product is available or sold out; 
  • other product information.

Any use of the Web shop, in whole or in part, that is not in accordance with these Terms of Use shall be considered an abuse of the services provided by JSP FASHION doo and a breach of the Terms of Use.

The online shop is intended for the realisation of sales and purchases via the internet and other means of communication, as well as the promotion of e-commerce.

  1. Statement of Conversion

All payments will be made in the local currency of the Republic of Serbia – the dinar (RSD). For indicative price displays in other currencies, the mid-rate of the National Bank of Serbia is used. The amount your payment card will be charged will be in your local currency, converted at the rate used by the card schemes, which is not known to us at the time of the transaction. As a result of this conversion, there may be a slight difference from the original price stated on our website.

  1. User registration

By registering to access the Web shop, by making a one-off purchase using the “Guest” option, or by accessing other electronic communication channels to complete a purchase (purchasing by telephone), as well as for informational and educational purposes, the user declares that they have been informed of the content of the Terms of Use, and that they accept its provisions, and are obliged to comply with the applicable regulations of the Republic of Serbia when using the Web shop for any purpose.

By registering to use the web shop for the purpose of a sale, by accessing the web shop for a one-off sale, by accessing via other channels of electronic communication for the purpose of a sale, as well as for informational and educational purposes (where applicable), Users agree to these Terms of Use and thereby enter into an Access Agreement with the Service Provider.

The user is obliged, when creating an account and on each subsequent entry of data, to provide accurate and complete personal data, in accordance with the Law on the Protection of Personal Data, the express consent of JSP FASHION Shop doo Kragujevac to process and store them for the purposes of fulfilling its obligations in relation to the Products ordered via the Web shop or its statutory obligations, debt collection, developing its terms and conditions, and preventing potential misuse.

In accordance with applicable regulations, JSP FASHION will take all available measures to protect the User's data, as well as the data relating to the purchase made. Such data will be considered a trade secret.

The User's data entered via the Web shop will not be used for the purpose of sending advertising communications, unless the User has previously given their express consent.

  1. Prices

Product prices on the website www.jspfashion.com are expressed in dinars and are stated as gross amounts (including all applicable taxes). The prices of the Products are subject to change until the purchase is confirmed by Online shop-i.e. the payment having been completed. Delivery of the Products purchased via Online shop-a is at the User's expense.

  1. Payment method

Payment for Products via the website www.jspfashion.com Payment can be made by cash on delivery or by bank transfer to the JSP FASHION account held at Raiffeisen Bank. In the case of cash on delivery, the customer pays the specified amount to the courier upon collection of the parcel.

  1. Shipping

Delivery of ordered Products by Online shopDelivery is made to the User's address as provided by the User upon registration. Delivery is only possible within the territory of the Republic of Serbia.

Upon registration of the ordered Products, JSP FASHION carries out a verification of the data it deems necessary, in compliance with applicable regulations, by checking against the databases of authorised authorities or by contacting the User, all with the aim of verifying that the conditions for completing the purchase have been met. Upon completion of the data verification and registration of the order, the User is provided with confirmation of their eligibility to purchase the Product, after which the ordered Product is delivered to the User.

  1. Complaints and Returns

We handle all complaints in accordance with the Consumer Protection Act (Official Gazette of RS, no. 62/2014 and 6/2016 – Dr. Law).

If you have received a delivery, and have found:

  • If you have received a product you did not order that is on the invoice
  • If you have received a product you did not order and it is not on the invoice
  • If you have not received the product you ordered which is on the invoice
  • That you received a product with an expired shelf life
  • If you have received a damaged product
  • If you have received a product that does not work

Please notify us of any damage to the delivery within 24 hours of receipt by telephone or email. If you are unable to notify us within this timeframe, please do so as soon as you are able. In such cases, we will resolve the issue in your favour as quickly as possible and in consultation with you.

In the event of a defect, we undertake to replace the product for you, and all replacement costs will be borne by JSP FASHION. JSP FASHION will replace the product with a new one or issue a refund as soon as possible, and in accordance with the legal procedure.

The buyer can return only with a receipt and the reason for the return written down:

  1. When ordering goods via the online shop, or by courier, the end customer has the legal right to return the goods within 14 days of the invoice date. Both working and non-working days are included in this period. 
  2. If a customer is returning an item received via courier service, the legal deadline for this, from the date on the receipt, is 14 days. The customer should send the item to the address:
  • Returned item and guarantee card
  • Original receipt
  • Reason for return written on paper

The returned product must be in the same condition as when it was acquired and must include all technical documentation (manual, declaration of conformity, warranty if applicable, packaging, etc.). The product must be free of any physical damage and signs of use. The customer is solely responsible for any diminished value of the goods resulting from handling them in a way that is not adequate, i.e., beyond what is necessary to establish the nature, characteristics and functionality of the goods. The cost of returning the goods is borne by the customer. After 14 days from the date of receipt, JSP FASHION is not obliged to provide a refund or an exchange.

Upon receipt of the goods sent in this way, the service will check the condition and correctness of the item and inform us so that we can either hand them over to the customer or send a replacement.

  1. Refund Policy

In the event of a return of goods and a refund to a customer who has previously paid in full or in part by card, regardless of the reason for the return, JSP FASHION is obliged to process refunds exclusively via VISA, EC/MC and Maestro payment methods, which means that the bank will, at the request of the merchant, credit the funds to the cardholder's account.

  1. Transaction data protection

When entering payment card details, confidential information is transmitted over a public network in a protected (encrypted) form, using the SSL protocol and the PKI system, as the most modern cryptographic technologies currently available. The security of data during the purchase is therefore guaranteed by the payment card processor, Raiffeisen Bank ad Belgrade, so the entire payment process is carried out on the bank's servers and the payment card details are never available to our system at any point.“

  1. Limitation of liability JSP FASHION

Use of the JSP FASHION online shop is at the user's sole risk.

JSP FASHION does not guarantee the uninterrupted use of the shop, nor is it in any way responsible for the temporary unavailability of any individual Service, nor for their partial or complete malfunction or incorrect functioning, nor for the consequences that may arise from the use of this shop.

JSP FASHION is not responsible for technical problems resulting from issues in the provision of electronic communications services, which may lead to delays and/or incorrect processing of electronic data, including the system clock, as this is the responsibility of the electronic communications operator (internet service providers) in accordance with the regulations governing the field of electronic communications.

JSP FASHION is not liable for any damage or injury that may arise from hidden defects, errors, interruptions, deletions, malfunctions, delays in operation or transmission, computer viruses, communication failures, theft, destruction or unauthorised access to data, alteration or misuse of data by third parties, breach of contract, conduct contrary to the Terms of Use, negligence and other causes.

JSP FASHION reserves the right to amend, cancel (temporarily or permanently) any element of its Platform, as well as the services it provides, and the content or entries, without prior or subsequent approval or notification, in accordance with good business practice, and in particular for the purpose of preserving the integrity of the Platform, data security and routine servicing.

  1. Processing and protection of personal data

Privacy Policy is an integral part of these Terms of Use. By accepting the Terms of Use, the user agrees that they have been informed of and accept the rules on the protection of personal data set out in this Policy.

  1. Protection of copyright, related rights and other intellectual property rights

JSP FASHION holds the exclusive copyright for the Web shop, as well as for individual elements that constitute it, such as text, visual and audio elements, visual identity, data and databases, programming code and other elements of the service. The exploitation of the aforementioned copyrighted items without the express prior written consent of JSP FASHION will be considered an infringement of copyright, and JSP FASHION will in that case be authorised to use all available legal remedies to enforce its rights.

JSP FASHION is solely responsible for the content for which it holds the copyright. Each party is individually responsible for the content that is its own copyrighted work.

  1. Transitional and final provisions

JSP FASHION reserves the right to amend or supplement these Terms of Use at any time, by publishing the amendments and additions in consolidated form on the website, and by sending registered users a notification via their email address about the changes to the Terms of Use, which will briefly outline the nature of the amendments. Thereafter, upon logging into our site, the notification of the changes to the Terms of Use will be available to every registered user. If registered users do not state that they do not agree with the changes (by sending a notification via e-mail address) and continue to use the Web shop, it will be considered that they have read and agreed to the changes. If a user does not agree with the changes (by sending a notification via e-mail address) within 5 days of their first login to the Web shop, JSP FASHION will delete their user account, after which their membership will terminate.

All matters not governed by these Terms of Use shall be subject to the applicable legislation of the Republic of Serbia.

All disputes that may arise between JSP FASHION and a member regarding the use of the online shop shall be governed by the applicable regulations of the Republic of Serbia. The parties undertake to attempt to resolve the dispute amicably, and should they fail, the competent court in Belgrade shall have jurisdiction. 

These Terms of Use come into force on the day they are published on the website, and begin to apply eight days from the date of their publication on the JSP FASHION website.
